By using the Assisting Individuals with Multiple Sclerosis (“AIMS”) website—www.helpaims.org—you agree to be bound by the terms and conditions below.   

MEDICAL INFORMATION DISCLAIMER

 We are proud to be a source of information about multiple sclerosis (“MS”). 

 The purpose of this website is to raise awareness and understanding of MS.  It is not intended to diagnose health conditions or take the place of professional medical care.    

 Instead, our goal is to educate and empower you to be a knowledgeable participant in your health care treatment plan, to be a resource for those you love who have MS, and to raise awareness about MS in your community. 

 Always seek the advice of your physician or other qualified medical health care provider with any questions you may have about your medical condition or treatment, and before you begin any new health regimen.  The use of this site does not create a doctor-patient relationship.  Never disregard any professional medical advice, or delay seeking advice or treatment, based on anything you read on this site.  If you have an immediate need for medical treatment, call 9-1-1.

 

 

YOUR PRIVACY

We collect the personally identifiable information that you choose to provide to us.

“Personally identifiable information” means information that is collected in conjunction with your name that alone (or when in combination with other information) may be used to identify or contact you, such as your name, email address, and phone number. 

How do we receive your info?  You may provide your personally identifiable information to us in a number of ways, including when you contact us so you can get involved and RSVP to join us for an event.  We may also have access to the personally identifiable information that you make publicly available when you connect with AIMS via social media.  We do not use cookies or any other technologies to track the activity of any visitors to our site.

 How do we use your info?  We use your personally identifiable information in order to share with you information about our programs and services as well as AIMS fundraising opportunities.  

 Do we share your info?  No, we do not provide or sell your personally identifiable information to any third parties. 

 How can you restrict our use of your info?  At any time, if you would like to opt out of any (or all) communications, please email us at helpaims@gmail.com and let us know if you would like to opt out of all future communications from AIMS, or just certain kinds of communications.  We will honor your request promptly.

Governmental, Law Enforcement, and Similar Disclosures.  We reserve the right to disclose your personally identifiable information without your consent if we believe doing so is required to comply with any applicable law, regulation, subpoena, or other governmental request. 

Data Security.  We maintain reasonable security practices to help protect against unauthorized disclosure of any information that you provide through our site.  Unfortunately, no data transmission over the internet or stored on a server can be guaranteed to be 100% secure.  As a result, while we strive to protect your personally identifiable information and privacy, we cannot guarantee or warrant its security and are not responsible for any inadvertent disclosure.  Accordingly, we assume no liability for any disclosure of data due to errors in transmission, unauthorized third party access, or other acts of third parties beyond our reasonable control.

Third Party Websites.  These Terms of Use apply solely to information collected by AIMS.  They do not apply to other websites that are accessible via links on our site—including, but not limited to, any third party websites that process payments on behalf of AIMS.  Please be aware that third party websites may have their own privacy and data collection policies and practices, and AIMS is not responsible for those sites’ actions or practices.  We encourage you to be aware when you leave our site and to read the privacy statements of all websites you visit.

Site Updates.  This site is under regular development, and changes may be made to our online materials and services at any time.  We reserve the right to change our Terms of Use at any time, so you should review this page periodically.

 No Warranties.  While we strive to make this site as accurate as possible, it should not be relied upon as being comprehensive or error-free.  This site is provided on an “as is,” “as available” basis, without warranties of any kind, express or implied, including, but not limited to, those of TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, or NON-INFRINGEMENT, or any warranty as to accuracy, timeliness, completeness, or arising from a course of dealing, usage, or trade practice.  No oral advice or written information provided on this site shall create a warranty, nor shall visitors to the site rely on any such information or advice.

 Endorsement Disclaimer.  We may reference products, services, and/or medical or service providers on this site, consistent with our educational purposes.  Any such reference does not constitute or imply an endorsement, sponsorship, or recommendation by AIMS. 

 Third Party Sites and Links.  Many—if not most—of the links we provide are not on our servers and are not maintained by us.  These links are provided simply as an informational resource.  We do not recommend, endorse, or approve of any of the content at the linked sites, nor are we responsible or liable for their availability, accuracy, or content.  Check the terms of use for any third party sites, as your use of those sites are bound by their terms.

 Disclaimer of Liability.  You assume all responsibility and risk for the use of this site.  Under no circumstances shall AIMS, its directors, and contributors, volunteers, or affiliated organizations (“AIMS Parties”) involved in creating or maintaining this site or providing services to, or in connection with, AIMS be liable for any DIRECT, INDIRECT, INCIDENTAL, SPECIAL or CONSEQUENTIAL DAMAGES, or LOST PROFITS that result directly or indirectly from the use or inability to use the site and/or any other web sites which are linked to this site—or that result directly or indirectly from mistakes, omissions, interruptions, deletion of files, viruses, errors, defects, or any failure of performance, communications failure, theft, destruction, or unauthorized access.  In no event will AIMS Parties be liable for any damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, this site. 

 To the extent liability cannot be limited as set forth above under applicable law, AIMS’s maximum liability arising out of, or in connection with, any use of this site, regardless of the cause of action, will not exceed $100.

Indemnification.  You agree to defend, indemnify, and hold harmless AIMS, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, suits, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of, or relating in any way to, your violation of these Terms of Use or use of this site.

 Governing Law and Limitation on Claims.  All disputes or claims arising from use of this site shall be governed by Illinois law.  You also acknowledge with respect to any dispute with AIMS arising out of or relating to your use of the site, you waive your right to serve as a representative, or to participate as a member of a class of claimants, against AIMS.  Any cause of action or claim you may have arising out of or relating to your use of this site must be commenced within one (1) year after the cause of action accrues, otherwise such cause of action or claim is permanently barred. 

Waiver and Severability.  No waiver by AIMS of any term within these Terms of Use shall be deemed a continuing waiver, and shall not prevent AIMS from asserting any right available to it under applicable law.  If any provision herein is held by a court to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement.  These Terms of Use constitute the sole and entire agreement between you and AIMS with respect to your use of this site.
